Defense of Neonatal Brain Damage Claim

Walter Melendres recently represented a hospital which involved profound neonatal brain damage allegedly secondary to anoxic or hypoxic insult during labor and delivery. The issue was whether the damage was incurred prior to the mother’s admission to the hospital, or during lengthy labor and post-birth resuscitation efforts. Mr. Melendres, in conjunction with experts, developed evidence that the brain injury occurred prior to admission to the hospital based on the interpretation by a pediatric neuroradiologist of a sonogram done shortly after birth and the interpretation by a neonatologist of heart, blood, and kidney test results done shortly after birth.
